TVXQ not allowed to continue group activities?

SM Entertainment will hold a press conference today regarding the conflict with TVXQ/DBSK/Tohoshinki.

Lawyers of SM Entertainment said:

"The court's ruling for TVXQ is not fair. They didn't consider the main reasons of the case. Their long contract is so that we can let them grow and have a long term deal with them. We want to look at their career in the long run and the court's decision is not letting us do that. This is going to affect TVXQ's international promotions. It'll also create confusion for stars that want to have long term contracts and move on to bigger things later in their careers and for the companies that want to nurture talented people for a longer time. Not only that, it'll have some unwanted consequences on exports of Korean music as well as other issues."

They continued to say:

"Each year, we adjusted the contracts in favor of the members. Before this problem, the three members never complained about anything. Now that they have succeeded this much, they are complaining. They have just started to reach the top and now want to separate. Before a final decision is made, the three can do their personal and individual work. However, this does not grant the three members any rights as part of TVXQ."

Because of all this, TVXQ has not been able to work and SM Entertainment will seek to receive compensation for damages during the time that TVXQ has been inactive.

Changmin and Yunho support SM Entertainment
Yunho and Changmin of DBSK/TVXQ have stated that they are on SM Entertainment's side on the legal dispute between the company and other three members.

They said that they trust SM Entertainment and will be with them in the future. The two also gave a deadline to the other members (Junsu, Yoochun, Jaejoong), expressing that DBSK will come back to promote in Korea next spring, so the other three members must make a decision before the 12th of this month
The two members' thoughts were delivered through a document compiled by Yunho and Changmin themselves, which stated:

We five members of DBSK signed the same contract with the same clauses for the past five years, and have worked together under same conditions with utmost trust in the company, each other and our dreams. We intend to share our dream and future with the company and keep the promises we made in the contract. DBSK was made by SME and we intend to work as DBSK with SME.

No other company can create DBSK, as only SME can provide the best production and management team available. The three members should know better than anyone else that SME is the one who knows DBSK the best and made us the best. We intend to keep trust and promise and thus intend to stay. DBSK's grand future will be with SME.

We believe that our Korean promotion, planned for next spring, should be prepared at least 6 months in advance before our future as one becomes unclear. If the other three members truly want to stay as one DBSK, they must make a decision before it's too late.

They also commented on the beauty product controversy which sparked this legal dispute between the DBSK trio and SM Entertainment:

The beauty product business changed everything. We are not familiar with the matters but we believe that a legitimate company that seeks to do business with DBSK must consult with SME first. It is common sense. We did not get involved because being such a relationship without SME would have meant that trouble was ahead.

We did not want the reputation and pride of DBSK, earned by our hard work, to be ruined by a company that did not work in a legally respectable manner. We are not aware of the contract between that company and the three members, nor do we know what those members were told or how much they have earned through their deal. What we do know is that the fact that DBSK, forged together for five years by all of our dreams, has fallen into its current state because of an unethical company that is simply unacceptable.

With DBSK crumbling away like this, the current situation is unbelievable. It is sad to see that this was all caused by some beauty product company, and we hope that the three members would come back to the days when we were all working hard for our dreams.

Yunho and Changmin’s fathers express strong disapproval of other members

Many readers and TVXQ/DBSK fans were shocked when members Yunho and Changmin revealed their support for SM Entertainment just an hour ago. But it looks like things aren't ending there - two other very important men involved with this controversy have decided to express their thoughts.

The fathers of Yunho and Changmin, the two TVXQ members who were not involved with the controversial lawsuit earlier this year, spoke up in support of their sons and SME while condemning other three members and their parents. They claim that the dispute has more to do with the trouble that has arisen from the beauty product business rather than mere contractual matters.

Mr. Chung, the father of Yunho, stated:

The two members who did not involve themselves in this legal dispute are the real victims here. They suffered from financial loss, psychological suffering and most importantly they lost their reputation. Who is to compensate them for their losses? I intend to ask the other three members this: Whatever the reason, why do you intend to cause such great controversy and drive DBSK, an international brand name, into a break-up? Do you care at all about the other two members and their suffering?

The beauty product business wasn't something that was supervised by SME. On top of that, the beauty product company itself wasn't very trustworthy. When it was started, I felt that DBSK's reputation could potentially suffer from involvement with that company and advised my son of the issue. He shared my concerns as well, and that is why he did not involve himself in the business. SME later asked the three members to withdraw from the business but their parents resisted unreasonably. Mr. Shim (Changmin's father) and I tried to convince them as well but they simply refused to change their minds. I later learned that the three members took up legal actions against SME without consulting me nor Mr. Shim. DBSK is not owned by those three members only. They ignored not only the controversy that would rise but also the rights of other two members.

Mr. Shim, father of Changmin, stated:

Simply put, the other three members took legal actions against SM because of the beauty product business matter and other reasons which involve their financial gains. What they claim as their reasons, reasons such as unfair contract and unclear profit division are merely excuses to hide the true reason behind their actions. After the three members started the beauty product business, one of the parents called me and told me shenanigans like "This business can be worth millions or even billions in the future. When we tell the media that DBSK has started a business, share price of our company will hit the roof - we will tell you in advance so you can profit from the information."

Three members claim that the contract is unfair and calculations are unclear, but my son and I have read over the contract with SM clearly and agreed to all clauses, from the very first contract through all five revisions that have been made. For every income my son has received I reviewed all of the the numbers. I feel sorry for the three members and their parents as they must know of the truth but they continue to make false claims."

CEO of SME calls the legal actions a “fraud”

After everything that has happened tonight, many are waiting for the official words from SM Entertainment, and allkpop is first to bring you the statements from a press conference that just took place!

The entertainment company held a press conference today and told their side of the story regarding their legal dispute with three members of TVXQ/DBSK. In addition to a statement by Yunho and Changmin, the two members who did not take legal actions against SME, and statements by their fathers, SME's own representatives spoke up as well; Mr. Kim Young Min, the CEO of the company, stated the following.

Back when we first advanced to Japanese market with S.E.S., major entertainment companies in Japan normally asked for contracts in length from 5 to 7 years. As long as the entertainer stayed with the company for the stated amount of time, the company would not cease investment into the entertainer. When we first planned for BoA to work in Japan, we set the length of the contract at 10 years to allow for long-term investment and a partnership with a major Japanese entertainment company. This resulted in SME working with AVEX, the largest entertainment company in Japan. BoA's great success in Japan was a product of such planning.

When we first planned for DBSK, we wanted to make them the number one artist in Asia. Five members and their parents shared such vision and agreed to add 3 years to initial 10 year contract. The members and their parents agreed to the contract because they found the vision as the number one artist in Asia, constant support from SM, plans to go abroad and continuous investment into the group very appealing. Everyone thoroughly reviewed the contract and agreed to all clauses. To keep the promise of advancement into Japan, SME invested over $4 mil into DBSK despite poor financial condition that the company was in. After 5 years in Japan, we can finally say that we are successful. It is unfair to focus merely on the number 13 without any background knowledge of how the contract was made and the goals and visions shared between SME and DBSK.

Kim Young Min then revealed some startling events that had occurred earlier this year.

On January 6, 2009, the three members told SM that they were going to China for a vacation; but in fact, they attended a meeting with the beauty product company's Chinese subsidiary to talk about investment into the company. We only realized of the deal after photos of them promoting the company surfaced online. We then learned that the three members are board members of the Chinese subsidiary and that they even carry business cards of the company with their name and position engraved.

The three members demanded an increase in their share in profit and we accepted their demands. In April, we had a dinner party after our concert in China. The three members told members of other groups about how much they trusted in SM. Shortly after in May, a Japanese fan asked AVEX's customer service department regarding an event by the beauty product company which claimed that the winner would have dinner with DBSK. SME feared that losses resulting from matters related to the beauty product business would be impossible to recover from. We wanted to review the members' contracts with the beauty product company to protect the members from potential dangers but they refused to share the contract with SME and did not take any actions to relieve SME from our concerns regarding their investment into that company. In June, a major beauty product company contacted us and said that they wanted to use DBSK in their commercials but the three members refused due to their own interest in beauty product business. Shortly after they took legal actions against SME.

The truth face of their action is a fraud. A fraud which fooled the entire nation with words such as "human rights" and "slavery".

Regarding the recent court ruling; three members are now free to pursue personal projects, however all DBSK-related work must be done through SME. Yunho and Changmin intend to promote DBSK in Korea next spring, and we feel that it should be planned at least six months in advance. SME asks the three members to respond to this by November 12th.

Jaejoong, Junsu, and Yoochun react to SM Press Conference

TVXQ / DBSK / Tohoshinki Members Hero Jaejoong, Xiah Junsu, and Micky Yoochun recently held a phone interview with Sports Seoul and shared their feelings about the press conference held by SM Entertainment.

In the press conference, SM Entertainment said that the root cause of all this trouble was the investment into the Chinese cosmetic company. During the phone interview with Sports Seoul, the trio of Jaejoong, Junsu, and Yoochun stated that they watched the press conference together. They had issues that SM Entertainment stated the root cause was with the investment into the cosmetic company. They state that this cosmetic issue has nothing to do with the suspension of exclusive contract as their activities as TVXQ are more important than a cosmetic company. They also stated that they pulled out of the cosmetic company to avoid controversy. They did admit that the cosmetic company controversy played some part into their decision for the suspension of the exclusive contract but emphasized once again that they pulled out of the company.

The trio also stated that having TVXQ continue together is the most important goal but SM Entertainment abused their position in authority and have cheated them out of billions of won (millions of dollars). They stated that they're worried about their fans and that the fans will be the ones suffering the most through this trial. They closed their conversation by stating they will discuss the next steps with their lawyers and proceed from there.

SHINee says SM is a family

SHINee, who recently returned with their 3rd mini-album 2009, Year Of Us and title track Ring Ding Dong, has spoken up on behalf of SM Entertainment.

Joynews24 had conducted an interview with the members of SHINee and asked if they knew about them being called the "puppets" of SME.

SHINee responded with a resounding statement:

That's prejudice against SM Entertainment. SME gives us a lot of say and freedom. Even during our album preparations, they ask us for our opinions. The albums are released under our name and thus it is our music. The public appear to have a predjudice against idols. Just like how the same song, Chocolate Love, can be presented differently by two different groups, SNSD and f(x), we have our own opinion and own colour. The company supports us, no doubt. However, being forced to do something does not and should not happen.

SME helped us a lot in the beginning as we didn't really know what to do. But as we gained more experience, we start to express our opinions. The company reflects our opinions on many things such as the lyrics, pairing of members and our style. Without such supportive environment, we won't be able to sing our songs like we sing them now.

They also expressed their pride in their company:

SME listens to the artists' opinions and everyone is close, unlike other entertainment companies. Everyone respects each other and supports each other, just like you can see in Dream Concert or SM Concert. Artists of SME are trained well from the beginning to the point where people say that SME's artists are very well mannered.

Regarding f(x), a recent rookie group that debuted from SME, SHINee said;

We've seen them since they were trainees but didn't expect them to debut so quickly. Did not think Sulli would be so tall and beautiful, haha. Now we know what it feels like to have juniors, and we can see why groups that are senior to us have been so nice and caring to us. We're following the tradition by giving lots of advice to f(x).

TVXQ Jaejoong, Junsu and Yoochun’s Full Statements

We previously reported about Jaejoong, Junsu and Yoochun's reaction to SM Entertainment's press conference. The full interview and statements from the 3 TVXQ members have now been revealed. Both parties are now in a full on battle and have added yet another layer of complexity to this already complicated story.

Q: Yunho and Changmin are still with SME.

"That is very unfortunate. SME offers unacceptable conditions to their artists. It breaks our hearts to know that Yunho and Changmin are still there."

Q: You have partially won the trial. How do you feel about your victory?"

"We're more worried about how Yunho and Changmin would feel confused about the ruling. They must have thought that SME, a major entertainment company, would win."

Q: Yesterday, Yunho and Changmin showed their support for SME.

"They can't help but do such thing. They have to do something like that because they're with SME. We've done a lot of things we didn't want to do as well, because we were forced."

Q: How are you finding their decision?

"It'd be a lie if we didn't find it somewhat bitter. But we know that they have their own story, so we understand them."

Q: What do you plan on earning through this lawsuit?"

"All we want is to part from SME. The contracts were unfair, especially the length of 13 years. Division of profit was problematic as well. The three of us have yet to receive our share of income amounting up to couple hundred thousand dollars each."

Q: Some view the lawsuit as the end of DBSK?

"We do not want to cease working as or break apart from DBSK. We just want to end our relationship with SME."

Q: Are you in contact with Yunho or Changmin?

"We lost contact with them after we took legal actions. But we can assume why that would have happened.

Q: How do you plan on maintaining your relationship with those two members?

"If they have something that is holding them back from talking to us, then we will fight to change that. They will speak up when the time comes."

Q: So you are willing to stay together with two other members?

"When this whole thing is over, we will resolve our misunderstandings with the two. We will wait for that day."

Q: Any plans on working as three?

"We will not release an album or perform on stage until Yunho and Changmin comes back to us."

Q: Are you going to stay together until the end with the other members?

"We want to keep DBSK. The stage means something only when all five of us are on it. We are one. We will walk in the name of DBSK until the end."

Shinhwa’s Andy speaks up about TVXQ issue

Andy from the old school group Shinhwa and whom recently returned with Single Man shared his feelings and sympathy towards TVXQ / DBSK / Tohoshinki.

If you didn't know, Shinhwa was formed by SM Entertainment back in 1998 and was one of the biggest groups in Kpop. They had a good run but they also had somewhat of a falling out with SM and left in 2003 to sign under Good Entertainment when their contract with SM was over. So Andy and Shinhwa in general should have good knowledge on what really goes on behind the scenes.

In an interview with AE Daily Andy stated, "I know what the TVXQ members are grieving over what has transpired recently. This is a real shame and I hope everything can be resolved in a manner in which neither TVXQ nor SM are hurt over this." When asked about the legal battle between the two parties he stated, "It's hard to choose a side and it's hard to determine who's right or wrong. I cannot give an opinion about it. However, I believe artists need to stand up on stage. I hope they don't lose their will and determination as artists. They should be thinking about their fans more than anything else."

Andy also recalled when Shinhwa as a group gathered to see TVXQ. He stated, "Back then, TVXQ were so cool and talented that it was frightening. To see them from that high point to the current situation that they're in is really sad. At that time I would've never imagined that this would've occurred."

Currently some members of Shinhwa are in the military while others are concentrating on solo activities. He closed the interview by stating, "When Shinhwa can regroup one day in the future, as one, we want to stand together with TVXQ on stage. I really want to see TVXQ come back again."

Cassiopeia releases statement about SME’s allegations

Members of the Korean Cassiopeia, TVXQ/DBSK's official fanclub, have released their official statement regarding SM Entertainment's press conference regarding legal dispute involving DBSK which took place yesterday. Here is the translated version of their statement:

We 800,000 Cassiopeians would like to announce our official view in this statement. With accusations and allegations flying everywhere, we announce this in order to show the fanclub's official standing on this matter. This statement is made by union of numerous DBSK fan cafes and we present this in the name of Cassiopeia.

First of all, we would like to say that, as fans of DBSK, we support DBSK and will not do anything to betray their trust in us. We will not trust anything besides words that come out of the DBSK members' mouths, and we ask SME to stop actions that are intended to confuse and divide the fans.

We Cassiopeians are very disappointed in SME for holding press conference and releasing signed documents in the name of Yunho and Changmin. As the management company of DBSK, SME must not forget their job and must stop their actions intended to defame the members of DBSK and break the group apart. Also, according the the court ruling made on the 27th, SME must not make deals with third parties in the name of the three members and cannot interfere with individual works or those members. Please keep the court's order.

To everyone who is reading this statement, please remember: the members did not take legal actions because of the issues regarding the cosmetics business. They started this lawsuit because of illegal contract length of 13 years. We fans do not understand why SME is silent about the issue of the contract length and is trying to focus everyone's attention on the cosmetics fiasco. The goal of this lawsuit was to nullify or edit contract between SME and the three members, and we believe that they did not intend to end DBSK or move onto another management company. Also, we would like to address to reporters who sensationalize and create rumours related to this press conference. Please be careful with your sources.

We would like to ask SME one more time to not make the three members' reputation and rights suffer with claims that have never been proven, and we would like to ask the citizens of Korea to stop creating rumours and defame DBSK. We would like to show our condolences toward this controversy.

As Cassiopeians, the fans of DBSK, we will keep our attention focused to the future actions of DBSK and SME. We will continue to side with DBSK. DBSK and fans never doubt.

Jaejoong, Junsu and Yoochun deny interview and statements

Earlier today, we reported an interview between three members of TVXQ and Sports Seoul.

Sports Seoul said that the interview was conducted through an acquaintance of the three members; now, another acquaintance of the three members claim that the interview did not take place. From a phone call with Nocut news, an acquaintance of the three members claimed, "No interview happened between Sports Seoul and the members. We do not plan on holding an interview any time soon. Please refrain from reporting stories using an acquaintance as the source."

The problem with this? This phone call was made by someone other than the three members themselves as well. Anybody here interested in paradoxes?

Stories on the TVXQ dispute have been so epic for the last 24 hours that they've got the drama rivaling that of a TV show. The plot thickens with deception and exposé... who is to trust and who is to ignore? Stay tuned to allkpop as we follow this controversy.

I can't believe I'm saying this but go cassiopeia~! They ftw~~~~ I am honestly divided by this but I'm going to stand strong that Junsu has to defend himself despite being attack by SM and SM "family".

TVXQ is one step closer to breaking up?

The three members of TVXQ who have taken legal action against SM Entertainment are planning to work by themselves, according to their legal counsel.

When Sports Seoul asked the three members' legal counsel about SME demanding the three members to make a decision by the 12th, they were told:

"The three members are taking a break at the moment and are planning new projects. We do not plan on responding to SME's press conference. SME was ordered by the court to submit relevant evidences and they have been ignoring this order for almost 3 months now and they also have not been following any other court orders. Conversations with SME will start when they start respecting the court's decision. The court said that the three members may work on their own, so we do not need SME's permission on that. We are also seriously considering making criminal accusations against SME."

The three members are now planning their own projects separate from that of the five-member TVXQ and in no way related to SME. They also do not intend on responding to SME's demand for an answer by the 12th. So what will be of TVXQ's future? Stay tuned to allkpop as the TVXQ dispute has just taken a turn for the worse.

Jaejoong & Yunho At First Official Press Conferences

TVXQ's U-Know Yunho and YoungWoong Jaejoong have been garnering attention for showing their support for each other at their individual press conferences after the dispute began.

The two people's friendship seemed not to have been disturbed in any way by the legal dispute with agency SM Entertainment. In fact, they both seemed to be trying hard not to accidentally bring harm to the other.

YoungWoong Jaejoong attended the press conference of 'Postman of Heaven' at 4:30 pm at the CGV at Wangship-li in Seoul on the 9th and said, "It was hard for me to decide to show my face at this press conference which is my first official outing since the trial," and "But I wanted to attend the press conference because this production was something I worked hard on a year ago."

He also said, "When I was filming the movie, it was a busy time as activities for the fourth album were going on at the same time. So the members couldn't give me a lot of advice but U-Know Yunho and Choikang Changmin supported me by telling me to work hard," and "I did not give U-Know Yunho advice when he began filming for his drama. I didn't worry about him because he's a friend who works as hard as he can in everything he does," and showed his deep trust and faith in U-Know Yunho.

He also showed his affection by saying, "U-Know Yunho is a friend who hardly ever says 'I'm tired', or 'I'm sick'."

At the press conference for MBC's drama 'Heading to the Ground', U-Know Yunho supported the three members who had a different stance than him by saying "I hope that the TVXQ dispute is ended in a good, reasonable way. There are a lot of bad rumors floating around but please don't believe them."

When more TVXQ-related questions were asked, he carefully said, "I don't know why everyone is thinking of it so negatively. There are a lot of bad rumors going around. I worry that these rumors are only worsening the situation. I hope that nobody believes in these rumors and from my point of view, I hope that everything ends in a good and reasonable manner."

On the other hand, SM Entertainment gave the ultimatum to the three members and said, "TVXQ will make a comeback next spring. Answer our question of your return by the 12th." An answer regarding this was not available from YoungWoong Jaejoong on the day of the press conference.

For the time being, I think SM is trying their hardest not to lose their gold in the company, DBSK is too precious to lose over a court dispute. Or at least that's how I view it, because this could have been settled amicably but SM doesn't want to lose either one of the DBSK member, that's why they keep holding onto to this battle, either that or they just unwilling to lose face.

TVXQ 2010 comeback is impossible?

Jaejoong, Junsu and Yoochun of TVXQ have yet to answer to SM Entertainment on what their final decision is.

SME revealed,

These three TVXQ members have refused to the upcoming activities as TVXQ so the TVXQ 3rd Asia Tour-Mirotic in China on the 21st is now canceled. The three say that they won't go to it. We regret to inform fans of this news. Because of this, TVXQ's image will be damaged. Not only will this affect TVXQ's Chinese promotions but it will also affect other Korean artists' promotions in China and Hallyu in general. They said to the court that they would continue with their planned activities but the concert in China that was planned in 2008, has now been turned down by them.

This press release statement continued,

We were also planning for a comeback in Korea next year. The three members have yet to reply to us about their national comeback. Because of that, their next year comeback has become impossible. We are sorry to be announcing this.

TVXQ trio will go to MAMA

Wow! The Mnet Asian Music Awards (MAMA), just may not be a complete failure anymore.

On the 19th, the three TVXQ members Xiah Junsu, Micky Yoochun and Youngwoong JaeJoong have decided to attend the MAMA's which will be held on November 21st.

An Mnet representative stated to Starnews:

"Youngwoong JaeJoong, Xiah Junsu and Micky Yoochun will attend the MAMA's and will be able to greet their fans after being away for a long time."

In addition they stated:

"However, we are not sure yet whether the 3 members will perform or just greet the fans on stage as of now."

Well, it's better than nothing right? Finally some good news for TVXQ fans and for the MAMA's.

XDD Oh hayden you know me. I might seem selfish but this point I could care less if TVXQ does break up (even though it'll break my heart into million pieces) because I don't want Junsu to suffer much in SM company. The reason why I love TVXQ in the first place because Junsu was born in it.

The three members of TVXQ accused of fraud in China!

Jaejoong, Micky Yoochun and Junsu, the three members of TVXQ / DBSK / Tohoshinki who took legal actions against SM Entertainment, have been sued for fraud in China along with Chinese subsidiary of the controversial cosmetics company CreBeau.

The plaintiff is a firm which is the distributor of CreBeau products in the Shanghai, Jiang Su and Sanxi region. A representative of the plaintiff stated:

"We were told by CreBeau that the three members were the board members of CreBeau, so we naturally believed that they will partake in promotions, which is the reason why we invested in this business. However, the three members did not appear on product announcement in Shanghai last July, resulting in fans complaining to us and returning the products. The overall loss that we suffered amount up to 1 million Yuan ($150,000). Yoochun and Junsu apologized to us regarding the matter but this fraud left us with too much damage, so we sent CreBeau a notice on October 22nd telling them to pay for the damage caused by their misrepresentation. However, we did not receive an answer and CreBeau closed their office in Beijing, so we had no choice but to sue them."

To this claim, CreBeau answered:

"We are analyzing this matter right now but it appears that they are making unreasonable claims. We have warned them about overly promoting the involvement of TVXQ members and it appears that they are suing them because we have stopped our ties with them due to various reasons. They say that we closed our office but in fact it just moved to another district of Beijing. Other distributors are doing fine in China."

The inaugural MAMA awards might have been over just recently, with the TVXQ trio of Jaejoong, Yoochun and Junsu making an appearance and receiving the "Best Representative for Asia" award on behalf of TVXQ.

But in a interview with SM Entertainment right after the MAMA was concluded, a representative said that they had no right to do so:

"The trio had no right to receive the award on behalf of TVXQ. The awards organizer should give the award to a liason on behalf of SM Entertainment instead. This is unacceptable since they had only invited the 3 members."

In response, a MNET representative stated:

"We invited all 5 TVXQ members to the MAMA awards ceremony beforehand. But only the trio responded to our request while the other two did not. We don't see any problems with the trio receiving the award on behalf of the whole group."

And the divide between both camps grows even wider after this.

SME forced someone to forge TVXQ’s signatures?

TVXQ fans, brace yourselves - yet another act has been added to the SME vs TVXQ battle, and it doesn't look pretty.

Earlier this month, SM Entertainment claimed that TVXQ had belatedly cancelled their appearance at the November 21 Shenzhen concert, and that members Junsu, Jaejoong and Yoochun had never requested the details of the Shenzhen concert contract.

In response to this statement, the legal counsel of Junsu, Jaejoong and Yoochun previously stated that they had obtained a handwritten statement from an individual claiming to have signed the note of confirmation without the TVXQ threesome's consent. A note of confirmation is a document ensuring the attendance of a performer at an event. Typically, the note is signed by a representative without any complaints because the artist is too busy to sign the documents themselves. However, the legal counsel has taken the stance that the TVXQ threesome had never given such consent.

Today, Junsu, Jaejoong and Yoochun's defense elaborated on their claim regarding SME's unauthorized signatures on this note.

Regarding the Shenzhen Concert situation, Junsu, Jaejoong and Yoochun did not sign [or approve the signing of] any note of confirmation. ... The note of confirmation for the Shenzhen, China concert holds signatures that have been forged.

Some Chinese and Korean fans had brought to our attention the fact that the signatures on the confirmation note seemed forged. After thorough examination, we have confirmed that these signatures are fake. ... The person that forged [the TVXQ members' signatures] gave us a hand-written note, which stated that a SME representative had ordered him to forge the signatures.

SM Entertainment previously said that there were no legal issues involving the sales of the Shenzhen Concert, yet they forged the signatures on this note of confirmation.

I, the writer of the note of confirmation, in March of 2009, followed orders from (censored) of SM Entertainment and signed the document for the Shenzhen concert in place of the three members. Neither I nor SM Entertainment had permission from the three members to use their signatures, before or after the document was released. The three members did not know about the Shenzhen Concert when they filed their lawsuit. The event was confirmed after the lawsuit had already been filed.

The legal counsel also claimed, "SME had made an agreement with the TVXQ threesome to go through with all pre-planned activities ... the Shenzhen concert was added into the TVXQ schedule after [this agreement was made]. SME is attempting to distort the facts."

They continued, "We ask that SME reveal the story behind the signature forgeries and also the full content of the Shenzhen concert contract. We want to eliminate any misunderstandings that may have arisen amongst fans from these events."

It seems like the TVXQ lawsuit is getting more convoluted by the day - if SME's statement is forged, how do we know that this alleged confession isn't a fabrication as well? With logical gaps in the arguments presented by both sides of the case, it's difficult to believe any statements being released by either side these days.

With all of these battles going on between SME and TVXQ, SME and Mnet and even HoMin and JaeChunSu, it feels like we're watching a multi-layered chess game. Stay tuned to allkpop as we await the next move in this complicated controversy.

TVXQ accused of yet another fraud

We had previously reported that CreBeau, the cosmetics company known for their involvement in the TVXQ controversy, got sued in China by a company that used to distribute their products in the Shanghai region. Now, CreBeau's Da Lia region distributor decided to do the same.

According to the plaintiff, Jaejoong, Yoochun and Junsu of TVXQ urged the plaintiff to distribute their cosmetics products claiming that they are shareholders of CreBeau and will personally take part in product promotion in the Da Lia region. The members did not show up for promotion and distributors from other regions informed the plaintiff that the CreBeau office has disappeared, forcing the plaintiff to sue CreBeau for fraud in order to compensate damage that they suffered. The plaintiff's claim is very similar to that of the Shanghai region distributor's, who also claimed that they suffered damage because TVXQ members falsely promised to show up for promotions and CreBeau's office disappeared.

TVXQ Trio to “Smile Again” with a fan meeting

We reported on a circulating rumor of TVXQ's Jaejoong, Yoochun, and Junsu holding their own secret fanmeeting quite a while ago, and the specific information toward this extravagant event have just been confirmed.

This fan meeting will be titled "Smile Again" and will be hosted by Yes24; it will take place on the 12th at 5 PM (KST) in a gymnasium in Korea University. Over than six thousand fans are expected to fill the bleachers to see these three boys once again.

Optional entrance fees will be collected from the fans during the event, and all the money will be donated to the charity for children. The trio has also agreed to this donation, and decided to earn no profit out of this event.

Unfortunately, the trio will not be attending under the name of TVXQ / DBSK / Tohoshinki for this meeting, but just their individual names of Jaejoong, Junsu, and Yoochun. They have decided the team name should not be mentioned, since the rights to use such title are fully reserved to all five members, and not just three. JaeChunSu will also not be singing any of the TVXQ songs during the meeting, due to the possibility of sparking another dispute over their rights to. Instead, the event will be filled with carol singing, and mostly interacting directly with the fans.

A representative revealed,

The date and location have been confirmed, however the time and the schedule of the event can be changed. Exact information will be arranged as soon as the three members arrive back in Korea from their activities in Japan.

The tickets for Smile Again will be available through Yes24's official homepage on the 8th starting from 8 PM. The price is free, however there is a limit of only one per person.

Dissension within TVXQ? Canceled Big East fan meeting

By now, many people already know about the ongoing struggle of the trio of Jaejoong, Micky, and Xiah Junsu from TVXQ / DBSK / Tohoshinki with SM Entertainment in Korea. Many fans, especially Big East (TVXQ's Official Japanese Fan Club) were convinced that TVXQ would continue on as Tohoshinki in Japan with no issues, Avex pretty much said so. However, recently there's been some signs of trouble in Japan.

Most notably, the most anticipated 4th Big East fan club meeting being canceled. The reason for the cancellation was because Tohoshinki stated that they wanted to be honest and couldn't stand in front of their fans and put on fake smiles, fake happiness. They want to meet fans when they can truly smile once again. There's been rumors flying around that this proves that their is dissension and problems within the group. Adding further fuel to the fire were the lack of communication and very awkward situation between Jaejoong / Micky / Xiah and Yunho / Changmin in their recent performances in Japan. It also doesn't help matters when Changmin and Yunho previously stating that they're in support of SM Entertainment.

Hopefully if this is true they can quickly patch things up. They have such a great thing going, and I wouldn't want to see all the hard work they put in together to go to waste. "TVXQ has been monitored in private", Japanese media

Japanese media revealed that while filming the latest PV in December, members of TVXQ were being forced not to communicate with each other.
SM Entertainment however responded that this is no evidence that they (SME) are monitoring the members in private.

On December 22, 2009, a Japanese weekly women magazine (Women's Self) stated that during the activities in Japan, the communication between TVXQ's has been forbidden and monitored since 3 of the members has filed a lawsuit against SME.

The magazine also wrote that during the activities in Japan, the members were unable to perform well as one. Though all of the members stayed in one room, there was a screen separating them into 3 - 2. Thus, this act seems to forbid interaction between members and to observe their actions. The same situation occurred while they were filming for the PV of their upcoming Japanese single, Break Out. Though the MV was filmed in Japan, there were staffs following them to disallow communication between members.

With regards to this, SME's representative replied via phone, "The article by Women's Self is purely rumour. It is creepy to have this thought that the members are being watched closely. Furthermore, we are in the generation where communication devices are everywhere. This could happen in the 1990s but in today's situation; monitoring them (TVXQ) is implausible and impossible. "
